Health Canada is pleased to announce the publication of its consultation on proposed Regulations Amending Certain Regulations Concerning Cannabis Research and Testing and Cannabis Beverages.

The consultation provides Canadians and interested stakeholders with the opportunity to comment on Health Canada’s proposed regulatory amendments to the Cannabis Act, the Cannabis Regulations, and the Cannabis Exemption (Food and Drugs Act) Regulations.

Health Canada is seeking feedback on the following proposed regulatory amendments to:

  • Create a new framework for non-therapeutic research on cannabis involving human participants to facilitate the conduct of such research with appropriate, risk-based regulatory controls;
  • Allow analytical testing licence holders and government laboratories to produce, distribute, and sell reference standards and test kits, which would increase access to cannabis testing materials;
  • Broaden the educational qualifications for the Head of Laboratory position for an analytical testing licence holder to allow for a larger pool of qualified candidates to occupy this role;
  • Amend Schedule 3 to the Act to increase the public possession limit for cannabis beverages, in order to address an unintended consequence of the current limit which restricts the possession of beverages to a greater extent than other forms of cannabis.

Comments on the proposed regulations should be submitted via the new online commenting feature in the Canada Gazette, Part I (CGI). This new feature is being piloted as part of this regulatory consultation.

Note that your comments will be posted on the Canada Gazette website for public review following the end of the consultation. You do have the right to submit your comments anonymously and if you choose to do so, your comments will be attributed to an anonymous individual.  Please note that Confidential Business Information should only be posted in the specific Confidential Business Information text box. The consultation will be available online for 45 days. Please note that all comments must be received by 11:59 pm EDT, April 25, 2022, when the consultation period ends.
